Dispute Resolution Policy
At Hourdeal, we strive to provide a positive and fair experience for all users. This Dispute Resolution Policy outlines the process for resolving disputes that may arise between users and the platform. By using Hourdeal, you agree to comply with this policy.
1. Informal Resolution
1.1 Good-faith communication: We encourage users to first attempt to resolve any disputes or disagreements through direct and open communication with the other party involved.
1.2 Mediation: If the parties are unable to reach a resolution through direct communication, we recommend using mediation services to help facilitate a fair and neutral discussion.
2. Formal Resolution
2.1 Escalation to formal dispute resolution: If the dispute remains unresolved after attempting informal resolution options, either party may initiate a formal dispute resolution process.
2.2 Arbitration: Any dispute arising out of or in connection with the use of the Hourdeal platform shall be submitted to binding arbitration. The arbitration will be conducted by a neutral arbitrator or arbitration organization agreed upon by both parties.
2.3 Arbitration process: The arbitration process will be conducted in accordance with the rules and procedures set forth by the chosen arbitration organization. The decision reached through arbitration will be final and binding on both parties.
3. Limitations
3.1 Small claims court: Notwithstanding the arbitration provision above, either party may choose to pursue a claim in small claims court if the claim qualifies for such proceedings.
3.2 Exceptions: This dispute resolution policy does not apply to disputes related to intellectual property rights or unauthorized access to the platform, for which the platform may seek injunctive or other equitable relief through the appropriate legal channels.
4. Waiver of Class Action
4.1 Class action waiver: Both parties agree that any claims or disputes will be brought on an individual basis and not as a plaintiff or class member in any purported class or representative action.
5. Governing Law and Jurisdiction
5.1 Governing law: This Dispute Resolution Policy shall be governed by and construed in accordance with the laws of the relevant state and country in which services are provided.
5.2 Jurisdiction: Any legal action or proceeding arising out of or relating to this Dispute Resolution Policy shall be brought in the courts of UK, and the parties hereby consent to the exclusive jurisdiction of such courts.
